Terms of Service
These Terms are a contract between Polaris Digital LLC ("Company") and you. goon.app is a service operated by Polaris Digital LLC. These Terms of Service ("Terms") govern your access to and use of goon.app (the "Service").
1. Acceptance of Terms & Updates
By creating an account, enabling paid features, or using the Service, you agree to be bound by these Terms and all referenced policies (including our Privacy Policy and Cookies disclosures). We may update these Terms from time to time by posting an updated version on the Service; continued use after the effective date constitutes your acceptance.
2. Eligibility & Age
You must be of legal age in your location to use the Service. Access by minors is strictly prohibited. We may require age-verification (including biometric or face-based checks provided by third-party vendors) and may block access in jurisdictions where adult services are restricted. You agree not to bypass regional restrictions, geoblocks, or age-verification.
2.1 Parental Controls
We encourage the use of operating system, device, ISP, and third‑party parental control tools to block underage access. See resources such as RTA parental controls.
3. Accounts & Security
- Provide accurate, current information. One account per person. No shared credentials.
- Keep your credentials secure; you are responsible for all activity under your account.
- We may suspend or terminate accounts for risk, abuse, fraud, or policy violations.
4. Payments, Billing & Refunds
Pricing, features, and limits may change. Subscriptions may auto-renew until cancelled. You are responsible for applicable taxes. Because AI generation consumes resources at the time of use, charges already incurred are generally non-refundable. We may review disputed charges; refunds will be issued where required by law. Partial refunds may be provided where required by law or at our discretion. Chargebacks may result in account suspension and content access loss.
AUTO-RENEWAL & CANCELLATION. SUBSCRIPTIONS RENEW AUTOMATICALLY UNTIL YOU CANCEL. You may cancel any time in Account → Billing. Cancellations take effect at the end of the current term.
4.1 Card Payments (Third‑Party Processor)
- We use third‑party payment processors to handle card payments. Your statement may show a merchant descriptor different from our brand name.
- Manage or cancel via your account settings and, where applicable, via the processor’s consumer portal or support.
- Reserves or payment holds may apply per processor risk rules. Processor terms govern payment disputes.
4.2 Crypto
- Crypto payments are generally final and non-reversible. Network fees and slippage may apply.
- If refunds are granted, they may be issued in the original currency or as account credit at our discretion.
- We are not a money transmitter and do not custody funds for others; on-/off-ramps are third parties with their own KYC/AML handled by those providers and subject to their terms.
4.3 Credits & Promotions
- Promotional trials and credits may expire as stated. Dunning and account limits may apply on failed renewals.
5. AI Output & Intellectual Property
You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, analyze, and moderate your prompts, inputs, and other content to operate, secure, and improve the Service (including use by human reviewers and automated systems). If we offer an opt-in for model training, your inputs/outputs may be used to improve the Service only if you opt in; otherwise they are used solely to provide the Service and ensure safety.
Subject to these Terms and third-party rights, we grant you a non-exclusive license (or, where explicitly stated, ownership) to use outputs generated for you. Outputs are not guaranteed to be unique or free of third-party rights, and similar prompts may produce similar outputs for others. You receive no rights to third-party IP referenced in prompts (e.g., logos or characters); you are responsible for ensuring your prompts/uses are lawful.
6. User Content (UGC) & License
If you upload or share content, you grant us a worldwide, sublicensable, transferable, royalty-free license to host, store, reproduce, adapt, publish, publicly display, and distribute such content solely to operate, provide, and moderate the Service. You represent and warrant you have all necessary rights. You may remove your content at any time; reasonable archival/backups may persist for a limited time.
7. Acceptable Use & Prohibited Content
7.1 Absolutely Prohibited
- Pedophilia; any depiction of minors or persons who appear to be minors; CSAM; age-regression; "young-looking" or ambiguous age content.
- Rape, sexual assault, or sexual brutality; non-consensual or coercive sexual content; drugged, unconscious, or otherwise incapacitated sex; sexual exploitation or trafficking.
- Incest; bestiality; necrophilia.
- Sexualized blood, gore, mutilation, dismemberment, or torture.
- Non-consensual intimate imagery; doxxing; threats; harassment; extortion; glorification of self-harm.
- Illegal activity, malware, scams, or instructions to commit crimes.
- Circumventing geoblocks, safety filters, or age-verification (including VPN/proxy evasion where restricted).
- No solicitation, arrangement, or promotion of prostitution, escorting, or any in-person sexual services, nor facilitation of the same.
7.2 Likeness & Deepfakes Consent
You must have verifiable written consent to generate or upload explicit content depicting any identifiable real person. We may require proof of consent and will remove content and/or suspend accounts on credible notice.
For alleged non-consensual intimate imagery (NCII), contact ncii@goon.app; we will promptly review and remove where appropriate and may require additional information to verify identity.
All company‑produced showcased content is AI‑generated; no 2257 records apply.
7.3 Safety Controls
Prompts/outputs may be filtered or blocked by safety systems that may err. We may change models, safety settings, or quality at any time to comply with law and manage risk.
7.4 Automation & Reverse Engineering
- No scraping, crawling, bulk downloading, data-mining, or rate-limit evasion of the Service.
- No reverse engineering, decompiling, or attempting to extract models, weights, prompts, safety filters, or APIs.
- No attempts to re-identify filtered content or jailbreak safety systems.
7.5 18+ Affirmation & Exemption for User‑Uploaded Content
Any actual human beings depicted in content appearing on this website were over the age of 18 at the time that content was recorded.
Exemption: User Uploaded Content. The operators of this website are not the "producers" with respect to any depictions of actual or simulated sexually explicit conduct which may be uploaded by users of this website. More specifically, the operators of this website limit their handling of such content, and only perform the activities of transmission, storage, retrieval, hosting, and/or formatting of material uploaded by users, all of which material appears on the website as the result of actions taken by third‑party users of the website. All portions of the website that contain such user‑generated material are under the control of the relevant user, for whom this website is provided as an online service by its operators.
Uploaders and producers are solely responsible for any record‑keeping obligations required by law (for example, 18 U.S.C. § 2257 and 28 C.F.R. Part 75, where applicable), including age and consent verification. We are not a primary producer of user‑uploaded content and may request documentation where permitted or required by law.
7.6 Terrorism & Physical Harm Violence
Content that depicts, promotes, or supports terrorism, violent extremism, or physical harm violence is strictly prohibited. This includes threats, praise or glorification of violent acts, recruitment or fundraising, depictions intended to intimidate or shock, and instructions for weapons, explosives, or other violent harm.
Report such content via our Contact page or emaillegal@goon.app. We may remove content, notify authorities, and suspend accounts.
8. Moderation & Enforcement
We may review content (by humans and automation), remove or geo-restrict content, throttle features, and suspend/terminate accounts at our discretion. We report suspected CSAM to NCMEC and law enforcement. We may retain logs as necessary for safety and legal compliance. We may use hash‑matching (e.g., NCMEC/PhotoDNA) and automated classifiers; false positives may occur.
8.1 Notice‑and‑Action Procedure (Non‑Copyright)
If you believe content is illegal or violates these Terms (other than copyright), report it via our Contact page or email support@goon.app with: (1) a substantiated explanation; (2) a precise URL; (3) your contact email; and (4) a good‑faith statement of accuracy.
We review reports in a timely, diligent manner and may temporarily restrict access while reviewing. Where required by law, we provide reasons to affected parties and an appeal path. We report suspected criminal content (e.g., CSAM, terrorism, credible threats) to authorities and may ban associated accounts.
9. DMCA / Copyright
We respect IP rights and comply with the DMCA. To submit a notice, email our Designated Agent with: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the material claimed to be infringing and information reasonably sufficient to locate it; (4) your contact information; (5) a good‑faith statement that the use is not authorized; and (6) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act.
Counter‑notice: If your content was removed by mistake or misidentification, send a counter‑notice with: (1) your signature; (2) identification of the removed material and its location before removal; (3) a statement under penalty of perjury that you have a good‑faith belief the material was removed due to mistake or misidentification; (4) your name, address, phone, and consent to jurisdiction of the federal court for your address (or Bernalillo County, NM, if outside the U.S.), and that you will accept service of process from the original complainant.

Our total liability arising out of or relating to the Service will not exceed the greater of US$100 or the fees you paid to us for the Service in the 12 months preceding the claim.
Nothing in these Terms limits liability for gross negligence or willful misconduct, or to the extent such limitation is prohibited by law. Some jurisdictions do not allow certain exclusions; in those places, these limits apply only to the extent permitted.
12. Indemnification
You will defend, indemnify, and hold harmless goon.app, Polaris Digital LLC, and their affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your content, prompts, likeness use, illegal access, or breach of these Terms or applicable law.
13. Governing Law; Venue; Arbitration
Informal Resolution. Before filing for arbitration, you agree to email legal@goon.app with a Notice of Dispute and allow 30 days to attempt to resolve the dispute informally.
These Terms are governed by the laws of the State of New Mexico, U.S.A., without regard to conflicts of law. Any dispute will be resolved by binding individual arbitration under the AAA Consumer Arbitration Rules, held in Albuquerque, New Mexico, unless we agree otherwise. If AAA is unavailable, arbitration will be administered by JAMS under its applicable consumer arbitration standards. Class actions and class arbitrations are waived. Either party may bring an individual claim in small‑claims court.
30‑Day Opt‑Out: You may opt out of arbitration within 30 days of accepting these Terms by emailing arbitration-optout@goon.app with the subject "Arbitration Opt‑Out" and your account email. This does not affect prior agreements to arbitrate.
Injunctive Relief: Either party may seek temporary or preliminary injunctive relief in court to protect intellectual property or confidential information.
14. Termination
We may suspend or terminate your access for cause, including violations of these Terms or law. Upon termination, your right to use the Service ceases; we may retain data as required by law and for legitimate business needs. Unused credits may expire or be forfeited per plan terms. Sections that by their nature should survive (e.g., IP, Disclaimers, Limitation of Liability, Indemnification, Arbitration) will survive termination.
15. Privacy; Data Processing
See our Privacy Policy. We use third‑party processors for age‑verification, fraud prevention, content delivery, and analytics. We honor cookie choices. If biometric/face age‑checks are used, provider details and deletion windows are described in the Privacy Policy.
If age‑verification uses biometric or face analysis, we store only the verification token and minimal metadata, not full images, except where law requires; retention periods and deletion windows are described in the Privacy Policy.
16. Jurisdiction‑Specific Disclosures
- California: See Privacy Policy for CPRA rights and required footer links if we sell or share personal information.
- EU/UK: See Privacy Policy for GDPR rights; a cookie consent manager is provided where required; imprint/legal notice provided where required.
- Prohibited Regions: You may not use the Service from embargoed countries or regions we geo‑restrict, or where age‑verification is required and not satisfied.
- Where local law requires age‑verification, you agree to complete age‑verification to access explicit sections; otherwise access will be blocked.
17. Export Controls & Sanctions
You may not use the Service in violation of U.S. export control or sanctions laws or other applicable restrictions.
18. Miscellaneous
- Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
- Assignment: You may not assign these Terms without our prior written consent; we may assign as part of a merger, acquisition, or asset sale.
- Severability: If any provision is unenforceable, the remainder remains in effect.
- Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.
